1. Acceptance of Terms
By downloading, installing, accessing, or using the CardWarden mobile application ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
You must be at least 13 years of age to use the full features of the App, including offline mode and account creation. By proceeding past the age verification screen in the App, you confirm that you are 13 years of age or older.
Children under the age of 13 may use the App only in Kids Mode. Kids Mode is designed for families with children to have peace of mind: a parent or guardian with a CardWarden account can invite a child to join their family using the "Add a child" feature, without the child needing to create an account of their own. In Kids Mode, the child has read-only access to cards that have been explicitly shared with them and nothing else — they can view those cards and update their balances, but cannot see any other cards, pockets, or account data, and cannot create their own account, pockets, or cards.
If you are a parent or guardian inviting a child under 13 to use Kids Mode, you represent that you have the legal authority to consent on behalf of the child and that you accept these Terms on their behalf.
2. Description of Service
CardWarden is a mobile application that helps you securely store and organize cards such as loyalty cards, gift cards, credit cards, debit cards, and membership cards. The App operates fully offline on your device. You may optionally create an account to access cloud features including backup, multi-device sync, and family sharing.
CardWarden is built on a zero-knowledge encryption model. Your sensitive card data is encrypted on your device before it is transmitted to our servers. We do not have access to your unencrypted data at any time.
3. Account Registration
Certain features of the App require you to create an account. When you register, you agree to:
- Provide accurate and complete information.
- Maintain and promptly update your account information to keep it current.
- Not share your login credentials with any other person. A single account may not be shared by multiple people.
- Promptly notify us at thesimplestnet@gmail.com if you become aware of any unauthorized use of your account.
You are responsible for all activity that occurs under your account, whether or not you authorized it.
4. Zero-Knowledge Architecture and Data Responsibility
CardWarden uses a zero-knowledge encryption architecture. This means:
- Your master password never leaves your device. It is used to derive the encryption keys that protect your data. We never receive, store, or have access to your master password.
- We cannot access your encrypted data. The data stored on our servers is encrypted and cannot be read by anyone without your master password, including us.
- We cannot recover your data. If you lose both your master password and your 12-word recovery phrase, your encrypted data becomes permanently inaccessible. We have no ability to reset your master password, decrypt your data, or restore access to your account on your behalf.
You acknowledge and accept that the security of your data depends entirely on your safekeeping of your master password and recovery phrase. thesimplest.net shall not be liable for any data loss, inability to access your account, or any other consequence resulting from your loss of these credentials.
5. Your Security Responsibilities
Because CardWarden is a security application that protects sensitive information, you play a critical role in keeping your data safe. You are solely responsible for the following:
Credentials and Recovery
- Choosing a strong, unique master password that is not reused on any other application, website, or service.
- Safeguarding your 12-word recovery phrase by storing it securely offline (for example, written on paper in a safe location). Storing the recovery phrase in digital form — such as in a notes app, email, cloud storage, or messaging app — increases the risk of it being compromised, and any resulting data loss is your responsibility.
- Not sharing your master password, recovery phrase, or account credentials with any other person.
Device and Environment Security
- Securing your device with a strong screen lock (PIN, password, pattern, or biometric) and not leaving your device unattended while unlocked.
- Not using the App on devices that have been rooted, jailbroken, or otherwise modified in ways that may compromise the device's security protections, including the hardware keystore or secure enclave.
- Not using the App on shared or public devices, such as those found in internet cafes, libraries, or shared workspaces, where others may have access to the device.
- Not granting accessibility, screen-reading, or overlay permissions to untrusted applications that could capture card data displayed on screen.
- Keeping your device operating system and the App updated to the latest available versions to ensure you receive the latest security patches and improvements.
Network and Public WiFi Safety
- Exercising extra caution when using the App on unsecured, shared, or public WiFi networks, including networks at airports, hotels, cafes, shopping centers, schools, workplaces, and public transport locations.
- Avoiding account sign-in, password changes, recovery actions, sharing, exports, or other sensitive actions while connected to public WiFi unless reasonably necessary.
- Using a reputable VPN when you must use public WiFi, and disconnecting from the network when you no longer need it.
- Confirming that your device is connected to the network you intended to use, and avoiding unknown or suspicious WiFi networks that may imitate legitimate public networks.
- Disabling automatic connection to open WiFi networks where possible and forgetting public networks after use.
- Not accepting unexpected certificate, security, login, or browser warnings while using the App or accessing related account services.
App Security Settings
- Enabling the security features available in the App, such as biometric unlock, app lock PIN, and an appropriate lock timeout setting.
- The App offers a "prevent screenshots" feature that attempts to block screen captures on supported screens. This feature is provided on a best-effort basis and relies on operating system capabilities. It may not be effective in all circumstances, including but not limited to screen recording software, accessibility services, or operating system-level bypasses. We do not guarantee that screenshots or screen captures will be prevented in every scenario.
- Not manually taking screenshots or screen recordings of sensitive card data displayed in the App. Screenshots and recordings are stored outside of the App's encrypted protection and may be automatically backed up to cloud services, synced across devices, or accessible by other applications.
- Not photographing the App screen with another device. Such photographs are entirely outside of CardWarden's control and protection, and could be inadvertently shared or accessed by others.
Sharing and Export
- Using strong, unique passphrases when sharing cards via encrypted share links.
- Not posting or transmitting card share links or QR codes through public or semi-public channels (such as social media, public forums, or large group chats) where unintended recipients could access them.
- Revoking shared access from family pocket members who should no longer have access.
- Securing any data files you export from the App (such as spreadsheet exports), storing them in a protected location, and deleting them when no longer needed. Exported files are not encrypted by CardWarden and are your responsibility to protect.
Account Hygiene
- Removing or deauthorizing devices from your account after loss, sale, or transfer of the device.
- Being vigilant against phishing attempts that impersonate CardWarden in order to capture your master password or other credentials.
- Promptly notifying us of any suspected unauthorized access to your account.
You acknowledge that any financial loss, personal loss, data exposure, or data loss resulting from your failure to follow these security responsibilities is solely your responsibility. thesimplest.net shall not be liable for any damages arising from your negligence in securing your account, device, credentials, or data.
6. Subscriptions and Payments
CardWarden offers optional paid subscription plans that unlock additional features such as cloud sync and family sharing. All subscriptions and payments are processed through the platform store (Google Play Store or Apple App Store) through which you downloaded the App.
- Subscription pricing, billing cycles, renewal, and cancellation are governed by the policies of the applicable platform store.
- Refund requests are handled exclusively by the platform store in accordance with their refund policies. thesimplest.net does not process payments or issue refunds directly.
- Subscription prices are subject to change at the end of a billing period. We will notify you of any price changes in advance, and the new price will take effect at the start of your next billing cycle.
- thesimplest.net does not collect, process, or store your payment details such as credit card numbers or billing addresses.
7. Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App for any illegal, fraudulent, or unauthorized purpose, including storing data related to illegal activity.
- Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent expressly permitted by applicable law.
- Interfere with or disrupt the App, its servers, or the networks connected to it.
- Use automated scripts, bots, or other automated means to access or interact with the App.
- Attempt to probe, scan, or test the vulnerability of the App or any related system or network, or breach any security or authentication measures.
- Abuse the sharing or family features to distribute card data beyond their intended use.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Use the App in any manner that could damage, disable, overburden, or impair the service.
8. Intellectual Property
The App, including its design, features, code, graphics, logos, and all related content, is the property of thesimplest.net and is protected by applicable intellectual property laws. All rights are reserved.
These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works based on the App or any part of it without our express written permission.
9. Third-Party Services
The App integrates with certain third-party services to provide its features, including:
- Authentication providers (Google Sign-In, Apple Sign-In) for account creation and login.
- Cloud hosting services for storing your encrypted data and enabling sync.
- Push notification services for delivering reminders and account notifications.
- Platform stores (Google Play Store, Apple App Store) for app distribution and subscription management.
Your use of these third-party services is governed by their respective terms of service and privacy policies. thesimplest.net is not responsible for the practices, availability, or content of any third-party services.
10. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied.
To the fullest extent permitted by applicable law, thesimplest.net disclaims all warranties, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Any warranty that the App will be uninterrupted, timely, secure, or error-free.
- Any warranty regarding the accuracy, reliability, or completeness of any content or data in the App.
- Any warranty that defects will be corrected or that the App or its servers are free of viruses or other harmful components.
While CardWarden employs strong encryption and security measures, no method of electronic storage or transmission is 100% secure. We cannot and do not guarantee absolute security. You use the App and store your data at your own risk.
You assume full responsibility and risk of loss resulting from your use of the App, including any data you store, share, or export through it.
11. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall thesimplest.net, its owners, officers, employees, agents, or affiliates be liable for any of the following, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not we have been informed of the possibility of such damage:
- Any indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, revenue, data, goodwill, or use.
- The cost of procurement of substitute goods or services.
- Any unauthorized access to or alteration of your data or transmissions.
- Any loss or damage resulting from your failure to maintain the confidentiality of your master password, recovery phrase, or account credentials.
- Any loss or damage resulting from your failure to secure your device, enable available security features, or follow the security responsibilities described in these Terms.
- Any loss or damage caused by data that has been exported, shared, screenshot, photographed, or otherwise removed from the App's encrypted protection.
- Any interruption, suspension, or termination of the service.
- Any bugs, viruses, or other harmful code that may be transmitted to or through the App by a third party.
- Statements or conduct of any third party on or related to the service.
If, notwithstanding the foregoing, thesimplest.net is found to be liable to you for any damage or loss arising from or connected to your use of the App, our total aggregate liability shall be limited to the amount you have actually paid to thesimplest.net through the App in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty Malaysian Ringgit (RM 50), whichever is greater.
This limitation of liability applies to the fullest extent permitted by law in the applicable jurisdiction. Some jurisdictions do not allow the exclusion or limitation of certain damages, in which case our liability shall be limited to the greatest extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless thesimplest.net, its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your use of the App or any activity under your account.
- Your violation of these Terms.
- Your violation of any rights of a third party.
- Your failure to comply with the security responsibilities described in these Terms.
- Any content or data you store, share, or transmit through the App.
13. Dispute Resolution and Arbitration
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the App ("Dispute") shall be resolved through binding arbitration administered by the Asian International Arbitration Centre (AIAC) in Kuala Lumpur, Malaysia, in accordance with its applicable arbitration rules. The arbitration shall be conducted by a single arbitrator. The language of arbitration shall be English.
The arbitrator's decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
Class Action Waiver
You agree that any Dispute will be resolved solely on an individual basis and not as part of any class, consolidated, or representative action or proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration against thesimplest.net.
Exceptions
Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.
Informal Resolution
Before initiating any arbitration, you agree to first contact us at thesimplestnet@gmail.com and attempt to resolve the Dispute informally for at least thirty (30) days. If the Dispute is not resolved within that period, either party may proceed to arbitration.
14. Account Termination
By you: You may delete your account at any time from within the App. Upon deletion, all your data stored on our servers will be permanently removed and cannot be recovered.
By us: thesimplest.net reserves the right to suspend or terminate your access to the App at any time, with or without cause and with or without notice, if we reasonably believe that you have violated these Terms or engaged in conduct that is harmful to other users, us, or third parties. We may also terminate or suspend accounts that have been inactive for an extended period.
Upon termination, your right to use the App ceases immediately. Any data stored on our servers associated with a terminated account will be permanently deleted. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 10, 11, 12, 13, and 17.
15. Modifications to These Terms
We reserve the right to modify these Terms at any time at our sole discretion. If we make material changes, we will provide at least thirty (30) days' notice before the changes take effect by posting the updated Terms with a new effective date.
Your continued use of the App after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App and delete your account.
16. General Provisions
Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and thesimplest.net regarding your use of the App and supersede all prior agreements, understandings, and communications, whether written or oral.
Waiver: The failure of thesimplest.net to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by thesimplest.net.
Assignment: You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. thesimplest.net may assign these Terms without restriction.
Force majeure: thesimplest.net shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or telecommunications failures, power outages, or cyberattacks.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles. Subject to the arbitration provisions in Section 13, any legal proceedings arising out of or relating to these Terms shall be brought exclusively in the courts of Kuala Lumpur, Malaysia, and you consent to the personal jurisdiction of such courts.
